AGP Mr. Sanjay Mukherjee ... for the State-respondent(s) Re Learned advocate for the petitioner submits that inspite of informing the Officer-in-charge of New Town Police Station in respect of threat and violence inflicted upon him at the behest of the private respondent no.4, no steps have been taken by the police authorities.

Learned advocate for the State has submitted a report which reflects that T.S. 639 of 2024 was registered for investigation. CCTV footage which was dated 24.02.2025 was also supplied to the

petitioner in support of his accusation.

However, the police authorities did not find, on examination of the CCTV footage, any incident of physical assault had taken place. Inspite of that, the police authorities have drawn up a proceeding under Section 126 of the BNSS.

Having considered the nature of relationship existing between the petitioner and the private respondents as also the fact that the police authorities have taken steps under Section 126 of the BNSS, I direct the police authorities to continue their surveillance and ensure that no untoward incident results because of the strained relationship existing between the parties.

However, if the petitioner is aggrieved by the inaction of the police authorities, he would approach the jurisdictional Magistrate under the relevant provisions of law. The learned Magistrate would assess and ascertain the facts of

the case, thereafter, pass necessary directions as he/she deems fit and proper.

With the aforesaid observations, WPA 13256 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. Copy of the report be handed over to the learned advocate for the petitioner.
