This is the second round of litigation between the parties. In the first round, W. P. A. 395 of 2021 was disposed of recording that Non-Drawal Certificate has been issued by the District Magistrate, Malda and a request dated 28.01.2021 has been made to the Secretary to the Govt. of West Bengal, Minority Affairs and Madrasah Education Department for reallocation of funds.

It appears from the order dated 28.01.2021 that the District Magistrate was expected to act expeditiously and take steps in that regard.

The respondent no. 2 shall take a decision in the matter as to the request of the District Magistrate, Malda dated 28.01.2021 within a period of three weeks from the date of communication of a copy of this order.

If the respondent no. 2 is of the view that the payment ought to be released to the petitioner, appropriate funds may be transferred to the District Magistrate, Malda for payment of the petitioner. It also appears that the Finance Ministry has approved and has released funds to the respondent no. 2 for payment of the petitioner.

With the aforesaid directions, the writ petition is disposed of.

There will be no order as to costs.
