Mr. Debasish Das .....for the petitioner Mr. Srinath Singha Roy ....for the State By presenting this writ petition claim has been laid for payment of interest on excess drawn amount which was refunded by State authorities in terms of the order dated 19th June, 2019 passed by a Coordinate Bench on a writ petition being WPA 6840 of 2019.

Petitioner retired on superannuation on 30th November, 2011 and for expeditious release of retiral dues on settlement of pension case by the State authorities petitioner deposited alleged excess drawn amount. After depositing the said amount petitioner received retiral dues on issuance of Pension Payment Order and subsequently petitioner filed writ petition being WPA 6840 of 2019 claiming refund of excess drawn amount along with interest. The Coordinate Bench vide order dated 19th June, 2019 directed State authorities to refund Rs. 1,82,076/- along with interest at applicable rate within a specified time. It is submitted by learned advocate representing the petitioner that

alleged excess drawn amount has been refunded to the petitioner along with interest in terms of the said order dated 19th June, 2019.

Therefore, further interest on the said alleged excess drawn amount is found impermissible and accordingly the writ petition is dismissed, without any order as to costs.
