Chakraborty Mr. Ashok Halder ...for the Petitioner Mr. Soumitra Bandyopadhyay Mr. Ayan Banerjee ...for the State The petitioner complains that the private respondents have raised unauthorised construction in the land adjacent to that of the petitioner, thereby obstructing the egress and ingress of the petitioner. The petitioner submitted a representation before the respondent no. 5 ventilating his grievance, on August 11, 2021 but the said representation has not been considered as yet. The petitioner prays for a direction upon the respondent no. 5 to consider the said representation.

Having considered the submissions made by the learned counsels appearing on behalf of the parties and the material on record, I dispose of the writ petition with a direction upon the respondent no. 5 to consider and dispose of the representation filed by the petitioner on August 11, 2021 within a period of three months from the date of communication of this order, after giving reasonable opportunity of hearing to all the affected parties including the petitioner, in accordance with law.

With the above observations and directions this writ petition being WPA No. 13996 of 2021 is disposed of. There shall be, however, no order as to costs. Since no affidavit in opposition is invited, the allegations contained in the petition are deemed not to be admitted.
