The writ petition is heard in presence of the learned advocates representing the petitioner and the respondent authorities.

The learned advocate representing the West Bengal Central School Service Commission has filed a report in the form of affidavit affirmed on 21st June, 2024 and the same is taken on record.

On perusal of the report, it appears that though petitioner made application for transfer on the ground of distance in between the present school of the petitioner and his place of residence but on appraisal of candidature of the petitioner for transfer he did not come within the zone of consideration.

In paragraph 6 of the report which is filed today it has been disclosed that in the first preferred school petitioner ranked 15th, in the second preferred school petitioner ranked 6th and in the third preferred school petitioner ranked 4th. Having considered the report, it appears that there is no flaw on the part of the Commission in not allowing the petitioner to be transferred on the ground of distance.

Accordingly, the writ petition stands dismissed.

However, this order shall not preclude the petitioner to apply for transfer afresh in future in accordance with law.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
