1. Learned Counsel appearing on behalf of the petitioner submits as follows. The petitioner and his three years old child were admitted in a hospital with some infection. One after the other, the hospitals could not cure them. Lastly, they were admitted at the Manipal Hospital, Mukundapur. Till now, they have not been cured and they have to take admission in a government hospital. The petitioner needs some time to pay the hospital bills due to such prolonged hospitalization. But, the petitioner and his minor son are not being allowed to leave because of nonpayment of bills.

2. Learned Senior Standing Counsel representing the State, after taking instruction from the hospital authorities over email, submits that the hospital authorities had asked the petitioner to take discharge earlier and have written to the petitioner that they may take discharge forthwith.

For the unpaid bills, the hospital authorities are going to take appropriate legal action.

3. In view of the above instruction, no further order need be passed in this regard.

4. Let the petitioner and his son be discharged and be allowed to leave the said hospital today by 6.30 pm.

5. Let the Officer-in-Charge of the Purba Jadavpur Police Station depute police personnel to stand guard at the hospital when the petitioner comes out of the said hospital with his minor son and wife.

6. The hospital authorities shall be at liberty to take appropriate legal action in respect of the dues.

7. With these observations, the writ petition is disposed of.
