Perused the report of the medical board submitted in a sealed cover before the Registrar General of this Court.

It appears therefrom that the Board of Officers assembled at the Composite Hospital, BSF Kolkata as per the direction of the Hon'ble High Court. The petitioner was admitted in the hospital for observation of his present physical and mental health condition. He underwent relevant medical checkup for investigation.

CT scan of brain, 2D-ECHO, EEG and other blood test were conducted. The opinion of the cardiologist, neurologist and psychiatrist were taken. The Board opined that though the petitioner is physically fit but he is mentally unfit to handle duties with arms/ammunition especially in stressful situations.

On perusal of the medical report forwarded by the respondent authority, the Court is not inclined to

interfere with the order of retirement of the petitioner on the ground of physical unfitness.

As the petitioner has already been medically retired from service, let his terminal dues to be disbursed without any further delay.

6.

The writ petition fails and is hereby dismissed along with the connected application.

7.

Let a copy of the medical report be forwarded to the petitioner.

Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
