Shri Sasadhar Das Mr. Subham Das ....for the petitioner This application under Article of the Constitution of India is at the instance of the defendant and is directed against an order dated May 13, 2024 passed by the learned Civil Judge (Sr. Div.), Additional Court, Hooghly in Title Suit No.119 of 2024.

By the order impugned, the application under Section 151 of the Code of Civil Procedure was allowed directing the Inspector-in-Charge, Dhaniakhali Police Station to depute any police personnel to go to the suit shop room for opening the lock put in the shop room mentioned in the Ka-1 schedule property in the plaint and file a report in that respect within next date. On a query of the Court the learned advocate appearing for the petitioner could not apprise as to whether such order has been implemented.

For such reason, this Court is not inclined to interfere with the order at this stage.

At this stage, the learned advocate appearing for the petitioner prays that a direction be passed upon the learned Civil Judge (Sr. Div.), Additional Court, Hooghly

to dispose of Title Suit No.119 of 2024 as expeditiously as possible.

In the light of the submission made by the learned advocate for the petitioner, CO 1879 of 2024 stands disposed of by requesting the learned Civil Judge (Sr. Div.), Additional Court, Hooghly to make an endeavour to dispose of the interlocutory applications first without granting any unnecessary adjournments to either of the parties. After disposal of the interlocutory applications, the learned trial judge is requested to make an endeavour to dispose of the suit as expeditiously as possible. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
