On perusal of the writ petition, it appears that prayer is made for registering FIR based on complaint lodged.

It is submitted by learned advocate representing State respondents that present writ petition is filed chiefly praying for direction upon concerned police authorities to register FIR and on being dissatisfied with inaction of the police authorities petitioner has moved this writ petition.

Since prayer is made for registering FIR, there is an alternative remedy available under Section 175(3) of BNSS, 2023 by approaching jurisdictional Magistrate.

In this regard, reliance is placed on the judgment of the Hon'ble Supreme Court, reported in (2007) 6 SCC 171 (Aleque Padamsee & Ors. -v. Union of India & Ors.).

Hence, present writ petition is not entertained and same stands dismissed.

However, this order shall not preclude the petitioner to approach the jurisdictional Magistrate, in pursuit of remedy.
