Mr. Santanu Chatterjee ... for respondent no. 6 Heard learned advocates appearing for the parties including C.E.S.C. and the private respondents. The main grievance raised in this petition by the petitioner is that in spite of compliance of all the legal formalities by the petitioner and decision of C.E.S.C. authority to supply electricity by installing loop meter in common meter box position, till date meter has not been installed. Learned advocate appearing for C.E.S.C. submits that they are ready and willing to install the meter at the premises in question but due to physical resistance from the private respondents they are not able to install the meter. Learned advocate appearing for the private respondents submits that petitioner has already been enjoying electricity

from a meter lying in the name of his father, who had expired long back and petitioner cannot have two meters. Learned advocate appearing for the petitioner submits that petitioner is ready and willing to surrender the meter lying in the name of his father if the new meter is installed in his name and new electricity connection is given to him. Considering the facts and circumstances of the case and submissions of the parties, this writ petition being WPA 13371 of 2023 is disposed of by directing the respondent C.E.S.C. authority concerned to make arrangement for installation of electric meter in the name of the petitioner at the premises in question and in case the C.E.S.C.

authority concerned faces any physical resistance they will be entitled to take police help at the cost of the petitioner and also break upon the lock, if any, in the common meter box. The whole exercise should be completed by the C.E.S.C. authority within a period of two weeks from date. This order has been passed on condition that simultaneously the meter line in the name of the petitioner's father shall be disconnected.

With this observation and direction this writ petition being WPA 13371 of 2023 stands disposed of.
