State has submitted a report. The contents of the report disputes regarding the promissory note relied upon.

Be that as it may, since the police authorities, till date, only conducted an enquiry but did not act upon and/or proceeded to investigate the case, I grant

liberty to the present petitioner to approach the jurisdictional Magistrate under Section 175(3) of the BNSS. The learned Magistrate will assess regarding the accusations, try to find out whether any cognizable offence is made out, as also assess whether the facts of the case warrant any investigation to be conducted, thereafter, pass necessary order(s) by exercising his/her discretion.

With the aforesaid observations, WPA 14530 of 2024 is disposed of.

Pending application(s), if any, is also disposed of.
