Petitioner Mr. Chinmoy Pal Mr. Archan Dutta ...for the Petitioner Mr. Antarikhya Basu Ms. Suchismita Dutta ...for the State The petitioner's counsel submits that the petitioner is in custody for about 435 days and no contraband article was recovered from the possession of the petitioner and though the charge has been framed in the instant case but prosecution so far only completed examination-in-chief of P.W. 1, on 7th August, 2025 and the prosecution is required to examine 11 witnesses and as such nobody knows when the trial would be concluded and considering the period of detention and that it will take long time to conclude the trial, the petitioner may be released on bail on any terms and conditions.

Learned counsel appearing on behalf of the State opposes to the bail prayer contending that the contraband substance was recovered from the joint

possession of the petitioner and that the petitioner was in conscious possession of the seized substances which is reflected from the seizure list as well as from the charge sheet and that the trial is in progress and it is expected that within a short span of time the trial would be concluded.

Having heard the learned counsels appearing both the parties and on perusal of the materials collected during investigation including the seizure list and the statements recorded during investigation, I find that the petitioner has failed to overcome the restrictions imposed under Section 37 of the NDPS Act and as such his prayer for bail is rejected. However, the Trial Court is requested to expedite the trial and to come to a logical conclusion in the proceeding at an early date.

Accordingly, the prayer for bail is rejected. Accordingly, CRM (NDPS) 729 of 2025 is disposed of.
