Petitioner claims that he happens to be the owner of the land in favour of whom scheme has been allotted for construction of building under the Awas Yojana. However, the private respondents have been resisting the petitioner from raising the construction. To that effect, petitioner has informed the BDO as well as the local police authorities but till date there has been no assistance.

Learned advocate for the private respondents submits that a civil suit has been preferred being Title Suit No. 91 of 2021 before the learned Civil Judge (Senior Division), 1st Court,

Tamluk wherein an order of ad interim injunction was passed.

Having considered that the civil court is already in seisin of the issue and there is a land dispute existing between the petitioner and the private respondent, the petitioner would in the circumstances approach the civil court for appropriate remedies. So far as the police authorities are concerned, police authorities would keep a vigil and ensure that no untoward incident results because of the inimical relationship existing between the parties.
