Statements of witnesses including contemporaneous document i.e. seizure memo disclose recovery of narcotic substance i.e. 50 kgs. of Ganja, which is above commercial quantity from the petitioner. In view of the aforesaid fact, statutory restrictions under Section 37 of the NDPS Act and as prayer for bail of the petitioner was rejected earlier, we are not inclined in granting bail to him.

The application for bail is thus rejected.
