Learned advocate appearing for the petitioner submits that although Patuli Women Police Station Case no. 5 dated 12.08.2024 was registered for investigation under Sections 376/417/406/506 of the Indian Penal Code and the police authorities have submitted chargesheet. But the grievance of the petitioner is that no efforts were taken by the investigating agency for tracing out the misappropriation of money and/or two mobile phones which were the subject matter of complaint addressed while registering the FIR.

State has submitted a report. Report reflect that some investigation was done in respect of sum of Rs.8,00,000/- which had been paid by the complainant, however, there are no details available.

In view of the charge-sheet having been submitted, I direct that if the petitioner if so advised will pray for compliance of Section 230 of the BNSS. On inspection of

the copies on which the prosecution proposes to rely, petitioner if so advised will prefer an application under Section 193 of the BNSS. Learned Magistrate on receipt of such application would put in efforts for disposing the same within a period sixty days from the date of filing of such application.

With the aforesaid observations WPA 13390 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
