The instant application under Article 227 of the Constitution of India is at the instance of the plaintiff in a suit for declaration of title and permanent injunction being Title Suit No.1036 of 2009 pending before the 4th Court of learned Civil Judge (Junior Division) at Alipore, District 24 Parganas (South).

The petitioner is praying a direction for expeditious disposal of the suit.

The suit is pending since 2009, therefore the plaintiff can legitimately expect its logical conclusion without further unnecessary delay, particularly when it has reached to the stage of peremptory hearing, the learned Trial Judge is therefore requested to make all endeavour to dispose of the said suit as expeditiously as possible and in doing so, shall not entertain the prayer of the parties for any unnecessary adjournment. CO 1885 of 2024 is disposed of with the above observations, there shall be no order as to costs. Parties to act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, subject to compliance of all requisite formalities.
