Heard learned advocate appearing for the petitioner as well as the State respondents.

Petitioner has filed this writ petition along with an application being CAN 1 of 2023 for recalling/ modification of the order dated 15th June, 2023, by which petitioner was asked to implead the borrower as a party respondents. Learned advocate appearing for the petitioner submits that it has a very innocuous prayer in the writ petition that direction be passed upon the authority concerned to expedite the proceeding in question under Section 14 of the SARFAESI Act. Learned advocate for the petitioner submits that in view of innocuous prayer, the borrower is not going to be affected if such prayer is allowed

since the borrower is already a party in the SARFAESI Act proceeding.

Considering the submission of the parties and such statement of learned advocate appearing for the petitioner, I am inclined to dispose of this writ petition as well as the connected application by directing the respondent authorities concerned to expedite and conclude the aforesaid proceedings in question in accordance with law and by passing a reasoned and speaking order and after giving an opportunity of hearing to the interested parties within 8 weeks from the date of communication of this order. Accordingly, the writ petition being WPA 13407 of 2023 and the application being CAN 1 of 2023 are disposed of. ( Md. Nizamuddin, J.)
