Anwar Hossain Ms. Sreyashee Biswas .....For the State The present application has been filed by the de facto complainant for clarification of the earlier order passed by this Court in view of the Division Bench order which was earlier passed and which was not brought to the notice of this Court. Be that as it may, the earlier order passed by this Court reflects that an outer time frame was given for completion of the prosecution witnesses. It has been complained by the de facto complainant that the order is being mis-interpreted and the police authorities are not serious in the view of the fact that one of the witnesses did not turn up on the ground of illness on 10th February, 2023 and the court has closed the evidence of the said witnesses. It has also been informed that the next date has been fixed on 13th February, 2023 and 14th February, 2023.

The Superintendent of Police, Uttar Dinajpur will personally ensure that rest of the four witnesses who are all police officials should be present at 10:30 a.m. before the learned Trial Court. A report should be sent in respect of compliance on 16th February, 2023 regarding the status of the witnesses scheduled to be examined by the learned Trial Court.

Md. Anwar Hossain, learned advocate appearing for the State would communicate this order to the Superintendent of Police, Uttar Dinajpur so that immediate steps are taken in the weekend and the order implemented on 13th February, 2023.
