The writ petitioner is aggrieved by the fact that despite being L-1, her tender for running the main canteen at Kharagpur Workshop of South Eastern Railway was rejected.

It is submitted that the petitioner met all the eligibility criteria and she was the existing contractor. Counsel for the Railways places Clauses of the Tender documents with as regards annual turn over and the liquidity requirement. It is further submitted that the petitioner did not meet the eligibility criteria. It is also submitted that the work has been awarded to the respondent no.6, who is engaged for a substantial period under the work order and only about a month is left.

In that view of the matter, this Court is not inclined to interfere with the decision of the Tender Evaluation Committee.

Hence, the instant writ petition shall stand disposed of without any orders.

There will be no order as to costs.
