C.R.R 2068 of 2001 D/L 68 August 23, Bpg.

In Re: An application under Article 227of the Constitution of India; Sanjoy Das

Versus

Smt. Alpana Das and another The present revisional application was preferred challenging the order dated 19th May, 2001 passed by the learned Additional Sessions Judge, 4th Court, Nadia in Criminal Motion No.57 of 2000. The subject matter of challenge in the said revisional application before the learned sessions court was an order dated 16th July, 2001 passed by the learned Judicial Magistrate, Nabadwip in M.R. (Exu) Case No.101 of 2001. I have considered the order dated 16th July, 2001 which was passed by the learned Magistrate after considering the materials available in the case records and in respect of the arrears which accrued. Learned revisional court (being sessions court) appreciated the contentions and the reasons so assigned by the learned Judicial Magistrate. On an assessment of the order passed by the learned sessions court, I do not find that there is any illegality in the impugned order.

Records reflect that the revisional is pending for more than 20 years and is yet to be admitted. As such, no interference is called for.

Accordingly, CRR 2068 of 2001 is dismissed.

Pending application, if any, is consequently disposed of.
