1. By way of filing this public interest litigation petition the petitioners allege encroachment in the public land. In this regard a representation has been given for removal of the unauthorized construction and encroachment.

The Assistant Engineer, National Highway, Sub-Division, Public Works (Road) Directorate, Diamond Harbour has written to the Block Land and Land Reforms Officer, Kakdwip, South 24 Parganas on 6th May, 2024 to arrange for a joint inspection. The petitioners would state that in spite of the said communication no inspection has been conducted.

2. Thus, taking note of the communication of the Assistant Engineer, National Highway, Sub-Division, Public Works (Road) Directorate, Diamond Harbour dated 6th May, 2024 there will be a direction on the 3rd respondent to arrange a joint inspection along with 8th respondent after notice to the petitioners and private respondents. This direction shall be complied with within a period of twelve weeks from the date of receipt of the server copy of this order.
