1. Heard learned Counsel for both the parties.

2. The father of the victim girl is the informant. Mrs. Nayan Mondal who is stated to be 28 years old is present in Court today and the petitioner, viz, Tapas Mondal is stated to be 38 years old is also present in Court today.

3. Ms. Gomes, learned Counsel for the petitioner produced a marriage certificate issued by the competent Hindu Marriage Registrar in favour of the couple which has been registered on 07.09.2015. Both the parties are stated to have been blessed with a daughter, whose name is Tania Mondal (aged about 5+ years).

4. Taking into consideration the aforesaid facts and happy conjugal life of the parties, it is directed that the petitioner shall appear before the learned Additional Chief Judicial Magistrate, Tehatta, Nadia within four weeks from today in connection with Tehatta P.S. case No. 23 of 2012 dated 10.01.2012. On his appearance and application for bail the petitioner shall be released on bail on such terms and

conditions as deemed just and proper in the facts and circumstances of the case.

5. The learned Additional Chief Judicial Magistrate is directed to act on the server copy of this order.

6. Accordingly, the prayer for the anticipatory bail is allowed.
