Smt. Champa Mondal Mr. Anupam Hait ...for the petitioner This application under Article of the Constitution of India is at the instance of the father of a minor daughter and is directed against the order dated April 12, 2024 passed by the learned District Judge at Alipore in Act-VIII Case No.74 of 2024.

By the order impugned the prayer for interim custody was refused upon holding that any interim order of visitation without hearing the opposite party will be counter-productive and detrimental to the mental health of the minor.

This Court finds that the learned District Judge was right in not passing an order of visitation without hearing the opposite party.

At this stage, the learned advocate appearing for the petitioner submits that August 12, 2025 has been fixed for hearing of the application for visitation. CO 1891 of 2024 stands disposed of by requesting the learned District Judge at Alipore to make an endeavour to dispose of the application for visitation as

expeditiously as possible without granting any unnecessary adjournments to either of the parties. There will be no order as to costs.
