The genesis of the case on an assessment of the facts as represented by the learned advocate appearing for the petitioner as well as that of the private respondents reflect that there is a matrimonial dispute. Number of cases and counter-cases have been initiated. Petitioner's main grievance is that his information which was furnished with the police authorities were not responded neither any steps were taken by the police authorities, as such, petitioner was forced to approach this Court. Report has been submitted by the State which reflects that proceedings have been drawn up under Section 126 of the BNSS. Since the genesis of all these disputes between the petitioner and private

respondents arise out of earlier relationship, I am of the opinion that if the petitioner is aggrieved by the conduct of the police authorities in any manner so far as their act and action is concerned, he would be at liberty to approach the jurisdictional criminal court. The jurisdictional criminal court would assess and ascertain regarding the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations, WPA 13315 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the learned advocate appearing for the State be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
