The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with. The plaintiffs in a suit for partition are the petitioners in the instant application under Article 227 of the Constitution of India. The petitioners, alleging inordinate delay in disposal of the said suit and are praying a direction for expeditious disposal of it. It appears from the record that issues in the suit have not yet been framed, the direction as prayed for therefore is pre-matured. However, in view of the nature of the suit, the 2nd Court of learned Civil Judge (Senior Division), Howrah is requested to expedite the disposal of the Title Suit No.252 of 2022 and in doing so, shall not entertain the prayer of the parties for any unnecessary adjournment.

CO 1894 of 2024 is disposed of with the above observations without any order as to costs.
