Learned counsel for the State has filed the report and submits that petitioner No. 3, who is married sister-in-law of the victim, used to reside separately at P.S. Itahar, District Uttar Dinajpur. However, learned counsel submits that petitioner No. 1 and 2 used to reside together in the same house where the victim was residing and where the offence took place. It has further been submitted that the offences took place within five months of the marriage.

Learned counsel for the petitioner submits that the specific allegations are only against petitioner No.

1. It is a matter of record that the offence had taken

place within five months of marriage. Petitioner No. 2 used to reside on the same house.

Taking into the account the facts and circumstances of the case Court considers that no case is made for anticipatory bail or pre-arrest bail of Petitioner No. 1 and 2. However, since petitioner No. 3 is married sister-in-law and used to reside separately in her matrimonial house, let she be admitted to anticipatory bail furnishing personal bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of like amount each, one of whom shall be local, to the satisfaction of the Investigating Officer, subject to the conditions that she shall join and cooperate in the investigation as and when directed by the Investigating Officer and shall not threaten, tamper or intimidate the complainant or members of the family in any manner.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
