The defendant no. 1 in a suit for declaration and injunction is the petitioner of the present application under Article 227 of the Constitution of India. The part of the order no. 23 dated March 15, 2021 passed in Title Suit No. 906 of 2018 whereby the learned Trial Judge has accepted the belatedly filed written statement subject to payment of costs of Rs. 50,000/- is under challenge in the present revisional application.

The petitioner is aggrieved by the said amount of costs. The learned Trial Judge, in exercise of his discretion, has fixed the said amount of costs in which this Court is not inclined to interfere.

C.O. 1608 of 2021 is dismissed without any order as to costs.
