Learned counsel for the State submits that though the offence as of now lodged against the petitioner are bailable in nature but the petitioner failed to comply with the notice under Section 35(3) of the B.N.S.S. Act and filed an application before the learned Sessions Court which was turned down. Learned counsel for the petitioner undertakes that the petitioner shall join the investigation as and when directed by the Investigating Officer.
In view of the submission of the learned counsel for the State, let petitioner appear before I.O. on 18th July, 2025 at 4.30p.m. and on further days as and when directed by the I.O.
In case the I.O. feels necessary of affecting the arrest of the accused he may be released on anticipatory bail by furnishing personal bond of Rs. 5,000/- (Rupees five thousand only) with two sureties of like amount each, one of whom shall be local, subject to the conditions that petitioner shall join the investigation and cooperate in the investigation as and when directed by the Investigating Officer and shall threaten, intimidated or contact of the victim or the defecto complainant in any manner.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
