Learned advocate for the petitioner, state and the Union of India is present.

State has submitted a report. Report reflects that the respondent no. 4 namely one Raju Naskar was arrested in connection with another case and also produced before the jurisdictional Magistrate in connection with M. Execution Cases arising out of M. Case No. 16 of 2019.

In view of the process which were issued and were not being executed and the report reflects that presently the process has been executed, further pendency of the writ petition is unwarranted.

Learned advocate for the petitioner submits that whole of the dues which have accrued are yet to be recovered/paid by the respondent no. 4.

Learned Magistrate is directed to consider the prayer of the petitioner in tune with the provisions and purpose for which the same has been incorporated.

With the aforesaid observations WPA 14549 of 2024 is disposed of.

Report submitted by the state be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
