Affidavit of service filed in Court today is taken on record.

The report of the Divisional Fire Officer, South Kolkata Division dated 26th June, 2025 filed in Court today is taken on record.

The report mentions that the Fire Services Authority has no objection to open the 5th floor including the fire affected room for the sole purpose of repairing/restoring fire and life safety system, if forensic examinations are completed.

It has been submitted that the sample and evidence for conducting the forensic examination have already been collected and forwarded to the laboratory for preparing the report which is awaiting.

As the Fire Services Authority has recorded its no objection to open the 5th floor, the petitioner may open the 5th floor including the fire affected room only for the sole purpose of repairing/restoring fire and life safety system.

The subject building is a high rise where fire broke out in the fifth floor. Similar type of incident or accident cannot be ruled out in the future.

Keeping in mind the safety and security of life and property of the occupants and any person visiting the said building for any purpose it is directed that, business/mercantile activity may be permitted in the said high rise only after obtaining proper fire safety certificate from the authority in accordance with law. 8.
None will be permitted to commence or continue any business/mercantile activity in or from the said building without obtaining a proper fire safety certificate in compliance with the fire safety recommendation.

The writ petition stands disposed of.

Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
