Mr. Biswajit Hazra Mr. Archisman Sain Mr. Sk. Nadeem Ahmed ...for the Petitioner. Mr. Anand Keshari Mr. Santanu Talukdar ...for the State Prosecution case is that 47 kgs. of Ganja and a cash amount of Rs.41,87,280/- was recovered from the house owned by the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is a married lady and on the date of alleged seizure, she went to her parental house to visit with her mother when the police has allegedly recovered all the contraband substance and the cash amount. She further submits that she was not in conscious position of the seized articles. However, investigation has already been culminated into a charge-sheet and she is in custody for about seven months twelve days and, as such, she may be released on bail on any terms and conditions. Learned counsel appearing on behalf of the State opposed to the bail prayer contending that commercial

quantity of narcotic substance was recovered from the house owned by the petitioner and during investigation the deed of the house property in the name of the petitioner has been seized by police.

Having heard learned counsel appearing on behalf of the petitioner and the State and that, the petitioner failed to overcome the restrictions imposed under Section 37 of the NDPS Act, the prayer for bail is rejected Accordingly, CRM (NDPS) 731 of 2025 is disposed of. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
