Soma Paul Mr. Subir Banerjee Ms. Dipanwita Das.........for the petitioners It is submitted that in view of the judgment and order dated 16.05.2016 passed by learned Additional Sessions Judge, Kandi, Murshidabad in Criminal Appeal no. 03 of 2015 (Soma Pal Vs. Bidhan Chandra Pal and ors.), Stridhan materials have been seized by the I.O. on 28.10.2016 in between 13.45 hours to 15.05 hours.

A xerox copy of the same is also filed before this court, let it be kept with the record.

Under such circumstances, the petitioners do not want to proceed with the instant case.

Heard and on perusal of the seizure list it appears that the contention is correct. Accordingly, CRR 1887 of 2016 is dismissed for non-prosecution.

Consequently, the application being CRAN 1/2016 (Old CRAN 3209/2016) is thus disposed of.

Interim order, if any, stands vacated.

Let the order be communicated to the Ld. Court below for information.
