The Court is approached under Article 227 of the Constitution of India soliciting a direction to ensure expeditious disposal of a Matrimonial Suit being Mat. Suit No.149 of 2017, now pending before the learned Additional District Judge at Baruipur, South 24-Paraganas.

Learned Advocate appearing for the petitioner submits that several dates have been scheduled by the learned Court below for reconciliation, but that stage has not yet been over resulting in protraction to the ultimate disposal of the case.

Upon perusal of the impugned order, it appears that multiple dates have been there in the interest of reconciliation.

In view of the nature of the order being proposed to be made and having regard to the year of institution of the suit, the Court is of the view

that the point requires to be addressed is very short and simple requiring no extensive hearing and the matter may even be disposed of without inviting presence of the opposite party/wife. Accordingly, service upon the opposite party/wife stands dispensed with.

Learned Court below is directed to finish the reconciliation either on the scheduled date or if for any reasons whatsoever, the same could not be done, the same may be peremptorily done within four weeks thereafter providing sufficient opportunity of hearing to either of the parties, but without granting unnecessary adjournments. After reconciliation is over, the learned Court below must try to ensure expeditious disposal of the suit showing mark of commencement of the trial.

Petitioner is directed to communicate this order to the learned Court below as well as the opposite party/wife and her learned Advocate appearing for the suit in the court below so that both the parties may come prepared and ready for the effective utilisation of the dates scheduled by the learned Court below.

With this observation and direction, the revisional application stands disposed of.

Urgent xerox certified copy of this order be given to the parties on usual undertaking.
