Ray ...for the respondent nos. 6 to 10 The writ petitioner complains that the private respondents are obstructing him from effecting construction over the land belonging to him and over which sanction plan has been obtained lawfully from the local Panchayat.
Learned counsel for the State has submitted instructions. It appears that there is a civil suit between the writ petitioner and the private respondents that was the subject matter of T.S. No. 163 of 2016, pending before the learned Civil Judge (Junior Division), 2nd Court, Contai. The said suit is stated to have been dismissed for default on August 3, 2018.
The Officer-in-Charge, Egra Police Station shall ensure that there is absolutely no breach
of peace in the said area and that the petitioner is not in any way obstructed or disturbed by the private respondents.
With the aforesaid observations, the instant writ petition is disposed of.
There shall be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
