Mr. Himadri Sikhar Chakraborty Mr. Arunabha Maity ..for the State The petitioner has alleged unauthorised construction by the respondent no.6 on premises no. 51/1, Kalachand Nandi Lane, Police Station Bantra, District Howrah. The petitioner is aggrieved because the respondent no.6 has constructed a G+1 (two storied building).

Mr. Pain, learned advocate for the respondent no.6 submits the sanctioned building plan. The Howrah Municipal Corporation has permitted a two storied residential building on the said plot of land on October 6, 2020.

Mr. Banerjee, learned advocate for the Howrah Municipal Corporation submits on instructions, that a

G+1 building is being constructed and there is a sanction for such construction. Thus, nothing remains to be decided in the writ petition at this stage. The writ petition is disposed of in view of the fact that the allegation of the petitioner that a construction is being made without any sanction from the Corporation, is incorrect.

The report filed by the police authorities is kept on record.

There will be, however, no order as to costs. Parties are directed to act on the basis of the server copy of this order.
