Learned Advocate representing the petitioner on instruction submits that petitioner is desirous to join the post of Assistant Teacher in a Government aided Secondary Schools in Upper Primary Section on being selected in 1st State Level Selection Test, 2016 (Upper Primary).

However, it appears that recommendation was made by the Chairman, West Bengal Central School Service Commission on 8th April, 2025 in favour of the petitioner since the petitioner was selected in 1st SLST (Upper Primary). In the meantime, ninety days have passed as stipulated under Rule 17(3) of West Bengal School Service Commission (Selection for appointment to the post of Teachers for upper primary level of schools) Rules, 2016.

In terms of Rule 17(3) recommendation which was issued in favour of the petitioner has lost its force. Therefore, at this stage, no direction can be issued upon the concerned respondent Authorities which will permit

the petitioner to join the post of Assistant Teacher in secondary school as per recommendation memo dated 8th April, 2025.

Hence no relief can be granted to the petitioner. The writ petition being WPA/13197/2025 stands dismissed. However, this order shall not preclude the petitioner to take steps in accordance with law by making a prayer before the concerned Authority of the West Bengal Central School Service Commission for extension of validity of recommendation.
