Case No. 488 of 2019 under Sections 499/500 of the Indian Penal Code, 1860, pending before the learned Judicial Magistrate, 1st Court, Barrackpore. It appears that till date, the petitioner/complainant has not been examined under Section 200 of the Code of Criminal Procedure, 1973, by the learned Magistrate in the Court below. The delay in proceeding with the trial cannot solely be attributed to the learned Magistrate in the Court below in this pandemic situation.

However, in view of the fact that the petitioner/complainant has not been examined under Section 200 of the Code of Criminal Procedure, 1973, till date, this application is disposed of with a direction upon the learned Judicial Magistrate, 1st Court,

Barrackpore, to make an endeavour to conclude the examination of the petitioner/complainant within a period of one month from date and, thereafter, the learned Magistrate in the Court below will proceed with the complaint case in accordance with law. Since this order will not prejudice the opposite party no. 1, this revisional application is disposed of without serving notice to her.

The revisional application being C.R.R. 1779 of 2021 is, thus, disposed of.
