Mr. Goutam Dey Ms. Ankita Ghosh Ms. Akshita Nath ... for the petitioner Mr. Sandipan Banerjee Mr. Ankit Sureka ... for the HMC CAN 3 of 2025 has been filed praying for condonation of delay in preferring CAN 2 of 2024 which is a prayer for recalling of the order dated 30.11.2023 by which the writ petition was dismissed for default. It appears that there is a delay of about 31 days in praying for the restoration.

Considering the grounds as made out in the application for the delay and sufficient cause shown which is accepted, the delay is hereby condoned. CAN 3 of 2025 stands allowed and is accordingly disposed of. CAN 2 of 2024 is an application for recalling of the order dated 30.11.2023 and for restoration of the writ petition.

Considering the grounds as made out in the application for restoration being CAN 2 of 2024, the same is considered and allowed and, accordingly, the order dated 30.11.2023 is recalled.

WPA 10427 of 2016 is restored to its original file and number. As the respondents are being represented, further service is not required.

List the matter in the Combined Monthly List of May, 2025 for further hearing.
