Chatterjee ... for the opposite party no. 1 Learned Advocate-on-record has appeared today and has prayed for withdrawing the said revision on the ground that the petitioner had already preferred an appeal against the said judgment and order of conviction passed by the learned Magistrate and the said appeal is pending before the Court of learned Additional District and Sessions Judge, Fast Track 2nd Court, Calcutta.

It is further submitted that as directed by the learned appellate Court vide order No. 11 dated 08.04.2019, the petitioner has deposited a certain amount as directed by the Court and the said appeal is fixed for hearing in February, 2024. The present revision is, thus, prima facie, not maintainable.

Accordingly, the petitioner is permitted to withdraw the revisional application as prayed for.

The revisional application is accordingly disposed of as withdrawn.

All connected application, if any, stands disposed of.

Interim order, if any, stands vacated.

Let a copy of the order be sent to the learned trial court for compliance.
