Petitioner complains that although the petitioner's husband was murdered but the police authorities have only restricted the investigation, in respect of death in case of rash and negligent driving and to that extent commenced proceedings in connection with Titagarh PS Case No. 73/25 dated 01.03.2025. In spite of the petitioner informing and bringing the same to the knowledge of the investigating authority relating to the C.C.T.V. footage, the same was not made a part and parcel of the investigation, consequent to which the police authorities have arrived at a different conclusion. Learned advocate appearing for the State has submitted a report. Report reflects that police authorities on conclusion of investigation has
submitted charge sheet in connection with the aforesaid case. Since the charge sheet has already been submitted, petitioner would approach the jurisdictional Magistrate or the Court in seisin of Titagarh PS Case No. 73/25 and if so advised prefer application under section 193 of the BNSS after obtaining all the copies under section 230 of the BNSS.
Learned Magistrate on receipt of any application under section 193 of the BNSS would dispose of the same within a period of 60 days. With the aforesaid observations WPA 13364 of 2025 is disposed of.
Report so submitted be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
