akb Mr. Sanat Kumar Roy Mr. Abhishek Banerjee ...For the Petitioner Mr. Pantu Deb Roy Mr. Anand Farmania ...For the Respondents This is an application under Article 226 of the Constitution of India wherein the writ petitioners are aggrieved by non-consideration of their representation dated January 29, 2021 (Annexure 'P-3') at page 26 to this writ petition by the District Magistrate, Burdwan (Purba), being the respondent No. 2.

I have heard learned Counsel appearing on behalf of parties and perused the materials placed on record. I am of the view that the representation of the petitioners is required to be considered by the concerned respondent. In the light of the above, I direct the District Magistrate, Burdwan (Purba), being the respondent No. 2 to consider the representation dated January 29, 2021 made by the petitioners upon granting an opportunity of hearing to the representative of the petitioner and all other interested parties, and thereafter, pass necessary reasoned order within a period of six weeks from the date of communication of this order.

The reasoned order should be communicated to petitioners within a week from the date of passing such reasoned order.

With the aforesaid observation, the writ petition is disposed of. There shall be no order as to costs. Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of all formalities, on priority basis.
