1. Affidavit of service filed in Court today is taken on record.

2. The petitioner's application seeking transfer made on 3rd August, 2021 and 18th April, 2022 stood disallowed on the ground that the petitioner was a single subject teacher.

3. The petitioner made fresh application for transfer on spouse medical ground on 18th April, 2022. The same is pending consideration at the end of the head of the institution.

4. Without going into the merit of the prayer of the petitioner, the instant writ petition stands disposed of by directing the head of the institution to take necessary steps to consider the application for transfer made by the petitioner in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order.

5. If the Block Medical Officer of Health certifies in favour of the petitioner, then immediate necessary steps shall be taken by the school to forward the application of the petitioner to the District Inspector of Schools.

6. The District inspector of Schools shall take steps in the matter at the earliest but positively within a period of eight weeks from the date of receipt of all documents from the school.

7. The fate of the petitioner's application shall be made known to the petitioner immediately thereafter.

8. If the application of the petitioner is allowed, then necessary consequential steps shall be taken by the appropriate authority without any further delay.

9. The head of the institution shall keep in mind that the application for transfer being made on spouse medical ground does not require the necessity of maintaining the pupil-teacher ratio of the school.

10. The writ petition stands disposed of.

11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
