Mr. Supriya Ranjan Saha, Mr. Akash Sarkar ...for the petitioner In this application petitioner has prayed for expeditious disposal of the maintenance proceeding being Case No.551 of 2025 under Section 144 of the BNSS presently pending before learned Judicial Magistrate, 2nd Additional Court at Basirhat. Being aggrieved by the inordinate delay caused in disposal of the proceeding, learned Counsel for the petitioner submits that the petitioner filed the maintenance case being No.551 of 2025 along with a prayer for interim maintenance on 17.09.2025 but the said interim maintenance prayer has not yet been disposed of and, furthermore, the criminal proceeding has also not been advanced since its filing before the Trial Court. Therefore, he prayed for necessary direction upon the Court below.

Having heard learned Counsel for the petitioner and that the application for interim maintenance is pending for about 9 months, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 2483 of 2026 is hereby disposed of with a direction upon the Court below or the Court in charge of the Court below to dispose of the

petitioner's interim maintenance application filed on 17.09.2025 on the next date or preferably within a period of 60 days thereafter and the Court below will then proceed for expeditious disposal of the maintenance application being Case No.551 of 2025.
