Admittedly, the notice purportedly issued by the AntiCheating Section, DD of the Kolkata Police under Section 160 of the Code to the petitioner does not contain the memo number. It also does not have the date by which the compliance is to be done.

Therefore, the said notice is set aside.

However, the police authorities shall be at liberty to issue a proper notice to the petitioner under Section 160 of the Code.

Accordingly, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
