For the Opposite Party no. 2 The petitioner who is the husband of the private opposite party is aggrieved by the judgment and order dated 6th May, 2024 passed by the learned Additional Sessions Judge, 2nd Court, Katwa in Criminal Appeal no. 8 of 2023 directing the petitioner to pay Rs.10,000/- per month to the private opposite party as interim monetary relief. The application under Section 12 of the Protection of Women from Domestic Violence Act is pending before the learned trial Court.

The petitioner seeks liberty to withdraw the revisional application and place his contention before the learned trial Court at the time of hearing of the application under Section 12 of the Act.

Liberty is granted to the petitioner to withdraw the present application and canvass all the issues taken in the present application before the learned trial Court in the proceeding under Section 12 of the 2005 Act.

Pending disposal of the application under Section 12 of the Act, the petitioner shall continue to pay the interim

maintenance to the opposite party in terms of the judgment and order impugned dated 6th May, 2024.

The revisional application is dismissed as withdrawn. Urgent certified website copy of this order, if applied for, be given to the parties, upon compliance of requisite formalities. (Suvra Ghosh, J.)
