27.09.2021 rrc CRR 1883 of 2021 In re : An application under Sections 482 read with Section 483 of the Code of Criminal Procedure, 1973.

In the matter of : Manashi Ghosh @ Manasi Ghosh ..... petitioner Mr. Debapriya Samanta Mr. Snehasish Mukherjee ....For the petitioner It appears that the petitioner was granted maintenance of Rs.5,000/- per month by the learned Magistrate in the Court below to paid by the opposite party no. 2 in connection with a proceeding under Section 125 of the Code of Criminal Procedure, 1973.

The petitioner, thereafter, filed an application being Misc. Case No. 53 of 2021 under Section 127 of the Code of Criminal Procedure, 1973, seeking enhancement of maintenance by Rs.10,000/- per month.

It is the grievance of the petitioner that, till date, the application for enhancement has not been disposed of by the learned Magistrate in the Court below.

It cannot be expected from the learned Magistrate in the Court below in this pandemic situation to proceed with the proceeding pending before him at a normal pace. However, keeping in mind the innocuous nature of the prayer, I dispose of this revisional application with a direction upon the learned Magistrate in the Court below to dispose of the petition under Section 127 of the Code of Criminal Procedure, 1973, within a period of six months from date of resumption of the normal functioning of the Court.

With this observation, the application being CRR 1883 of 2021 is disposed of.

Since the opposite party no. 2 shall not be prejudiced by this order, this revisional application is disposed of without giving any notice to him.
