The grievance of the petitioner is directed against an order dated April 9, 2024 passed by the Seventh Industrial Tribunal in Case No.

48/2022/10(1B)(d).

It is submitted on behalf of the writ petitioner that in framing the issues during the course of hearing, the Tribunal has erred in not including an issue suggested by the petitioner being Issue No. 2(a).

On behalf of the respondent, it is submitted that the issues framed by the Tribunal are wide enough and cover the above issue.

The respondent no. 3 is represented and submits that they have no objection to the framing of the above issue.

The respondent no. 4 is also represented and does not object to the framing of the above issue.

In views of the submissions made on behalf of the parties, WPA 14704 of 2024 stands disposed of by including Issue No. 2(a) above as an issue in Case No. 48/2022/10(1B)(d) which is set out hereinbelow:

a) "Whether the termination from service of the Workmen by issuance of Termination Letter dated November 03, 2021 is illegal and unjustified?"

The question of jurisdiction of the Tribunal is left open and is to be decided by the Tribunal at the earliest.

The impugned order dated April 9, 2024 stands modified to the above extent only.
