Mr. K.M.Hossain Ms. Keya Sutradhar ... for the petitioner.
Mr. Gourab Das ... for the WBCSSC.
The writ petition is instituted, inter- alia, for permitting the petitioner to participate in the selection process of First State Level Selection Test, 2016 (SLST) for being appointed in the post of assistant teacher in upper primary section in a government aided secondary school upon condonation of age bar.
An affidavit has been filed on behalf of West Bengal Central School Service Commission by the Assistant Secretary affirmed on 2nd May, 2023 today wherefrom it appears that though petitioner was awarded 56.1200 marks but at the present moment the candidature of the petitioner is not considered since he is an untrained candidate.
It has been submitted on behalf of the Commission that trained candidates are being considered at present for being recommended for appointment in the post of assistant teacher in upper primary section. The name of the petitioner has been included in the list of untrained candidate.
In view of aforesaid facts no order need be passed on this writ petition save and except granting leave to the Commission to take steps in accordance with law in order to appraise the candidature of the petitioner being an untrained candidate in the event untrained candidates are considered for the post of assistant teacher in upper primary section in future.
Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
