1. Memo of evidence submitted be kept with the record.

2. Learned advocate appearing for the petitioner draws the attention of the Court to the order passed in Special Leave to Appeal (Crl.) No. 4140 of 2026, wherein, the co-accused similarly placed has been granted bail.

3. Learned advocate for the State is unable to refute such contention that the petitioner is not similarly situated as the other accused.

4. In view of the aforesaid, the petitioner be extended the same benefit. Learned Trial Court would release the petitioner, namely, Animesh Biswas on bail on same terms and conditions as was imposed upon the other accused, namely, Biplab Biswas.

5. Accordingly, CRM (NDPS) 1373 of 2026 is disposed of.

6. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.

7. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
