Petitioner is aggrieved by the fact that the representation which were informed to the Officer-inCharge, Cyber Crime Police Station, Kolkata also the superior officers of police, no steps have been taken. State has submitted a report. Report reflects that the police authorities have taken steps and they have arrived at a conclusion on their own reasoning. The report in fact gives an indication that the concerned officers of Cyber Crime Police Station, Kolkata were unable to detect any offence.

Be that as it may, the petitioner is seriously prejudiced in respect of the mail which has been circulated and are unable to know whereabouts of the genesis of such circulation of electronic communications.

Petitioner also complains that the outcome of such enquiry was never communicated to the petitioner which is disputed by the learned advocate for the State. Since the petitioner is apprehensive and intends to have the factual circumstances investigated, petitioner would be at liberty to approach the jurisdictional Magistrate, the jurisdictional Magistrate would address the issue in the background that the petitioner is not aware regarding the author of the mail for which the petitioner approached the police authorities. The learned Magistrate would assess and ascertain regarding the accusations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations WPA 13428 of 2025 is disposed of.

Report so submitted by the State be kept with the record.
